房屋租赁费纠分

 

我公司租用张某的房屋,签订了房屋租赁合同,但房主是李某。张某属转租。因为拆迁原因,合同提前解除,但张某因李某未退房屋租赁款,拒绝给我方退还房屋租赁款。请问我们能否直接向李某索要此款。有无法律依据?

你公司、张某、房主李某三方间存在有两个租赁合同。根据合同相对论原则,你公司只能向合同相对方张某主张退还租赁款。

一般没有权利要求李某退还,协议不知是怎么签署的?建议带着书面资料预约律师详谈。
